FOOD SAFETY & ALLERGEN NOTICE

Introduction

This Food Safety & Allergen Notice applies to food products offered through Chefs Collection Food & Supply, doing business as (DBA) Chefs Collection Food (“Chefs Collection,” “we,” “us,” or “our”).

Food products may be produced, prepared, packaged, stored, or handled by Chefs Collection Food and/or approved commercial kitchens, food producers, partner chefs, suppliers, manufacturers, production partners, or fulfillment providers, depending on the applicable product.

This Notice should be reviewed before ordering, particularly if you or the intended consumer has a food allergy, ingredient sensitivity, dietary restriction, or medically significant dietary requirement.

1. General Food Safety

Food products should be transported, stored, refrigerated, frozen, thawed, prepared, cooked, reheated, and consumed according to product instructions, labeling or packaging instructions, instructions provided with the order, and applicable safe food-handling practices.

Customers are responsible for prompt and proper handling after delivery or pickup.

Once an order has been properly delivered, picked up, or left at an authorized location under the applicable delivery arrangement, responsibility for timely retrieval, refrigeration, freezing, storage, preparation, reheating, and other appropriate handling transfers to the customer to the extent permitted by law.

2. Ingredients and Major Food Allergens

Products may contain or be prepared, processed, stored, or handled in environments that use major food allergens or other ingredients capable of causing allergic reactions, sensitivities, or dietary concerns.

Major food allergens may include:

• milk;
• eggs;
• fish;
• crustacean shellfish;
• tree nuts;
• peanuts;
• wheat;
• soybeans;
• sesame; and
• ingredients derived from or containing these allergens.

Products may also contain other ingredients that can cause individual reactions or sensitivities.

Ingredient and allergen information may vary by product, recipe, chef, producer, facility, supplier, manufacturer, or production partner. Customers should review the information available for the specific product being ordered.

3. Cross-Contact

Commercial kitchens, production facilities, preparation areas, storage areas, equipment, utensils, packaging environments, and fulfillment environments may handle multiple ingredients and allergens.

Unless a specific product is expressly represented in writing as being produced under conditions supporting a particular allergen-free claim, customers should not assume that a product or preparation environment is free from cross-contact with a particular allergen.

The absence of an allergen from a product description does not by itself constitute a guarantee that cross-contact cannot occur.

4. Allergies, Dietary Restrictions, and Special Requests

Customers with food allergies, ingredient sensitivities, dietary restrictions, ingredient concerns, or medically significant dietary requirements should review the current product information and contact Chefs Collection Food before ordering whenever clarification is needed.

A request, note, message, delivery instruction, order comment, or other communication concerning an allergy, ingredient, dietary restriction, substitution, preparation method, or special handling requirement is not considered accepted or guaranteed merely because it was submitted or acknowledged.

Any accommodation applies only if Chefs Collection Food expressly confirms in writing the specific accommodation we are able to provide for the applicable product and order. Unless we expressly state otherwise in writing, such confirmation does not constitute a guarantee that cross-contact cannot occur.

Chefs Collection Food does not represent that any product is suitable for a medically prescribed diet unless that suitability is expressly stated in writing for the specific product and applicable order.

If you have a severe or medically significant food allergy, you should not rely solely on general website descriptions when deciding whether a product is appropriate for you.

5. Partner Chefs, Producers, Suppliers, and Production Partners

Chefs Collection Food may obtain ingredient, allergen, production, permit, certification, labeling, and related product information from approved production partners, commercial kitchens, partner chefs, food producers, suppliers, manufacturers, and brands.

Those parties remain responsible for the accuracy and compliance of information they are legally required to provide.

Chefs Collection Food may also establish additional food-safety, documentation, labeling, quality-control, insurance, or participation requirements for parties whose products or services are offered through or used in connection with our platform.

Nothing in this section limits Chefs Collection Food & Supply’s responsibilities to customers as seller and merchant of record where applicable law imposes those responsibilities on us.

6. Recipe, Ingredient, Supplier, and Production Changes

Recipes, ingredients, formulations, suppliers, brands, production partners, commercial kitchens, facilities, manufacturers, and manufacturing or preparation processes may change.

For this reason, customers with allergies, sensitivities, or dietary restrictions should review the current product information each time they order, even if they have purchased the same or a similar product previously.

Previous ingredient, recipe, allergen, or production information should not automatically be assumed to remain unchanged for a future order.

7. Refrigeration, Freezing, Storage, Reheating, and Consumption

Customers should promptly refrigerate or freeze temperature-sensitive food as appropriate after delivery or pickup.

Customers should follow applicable refrigeration instructions, freezing instructions, thawing instructions, cooking instructions, reheating instructions, storage instructions, use-by or similar product instructions, and other food-safety directions provided with the product.

Partial softening or thawing during local transport does not automatically mean that a refrigerated or frozen product is defective if the product remains properly cold and safe.

Food should not be consumed if the customer reasonably believes that it has become unsafe because of improper time or temperature exposure, contamination, damaged or compromised packaging, spoilage, improper storage, or another material food-safety concern.

When in doubt about the safety of a product, do not consume it.

8. Food-Safety or Allergen Concerns at Receipt

If a product appears materially compromised, contaminated, unsafe, incorrectly supplied in a manner affecting food safety, or otherwise presents a material food-safety concern at the time of delivery or pickup, do not consume the affected product.

Contact Chefs Collection Food promptly under the 24-hour order-issue claim procedure in our Return, Refund & Cancellation Policy.

The 24-hour period is an order-issue reporting requirement and does not represent a statement that a food product is safe for any particular period of time. If you reasonably believe a product is unsafe, do not consume it regardless of when the concern is identified.

To support review, we may reasonably request your order number, a description of the issue, photographs or videos, packaging or label information, temperature information where relevant, delivery or pickup information, and other reasonable information necessary to evaluate the concern.

Where reasonably safe to do so, preserve the affected product, packaging, labels, delivery bags, and temperature-control materials until our review is complete. Do not retain or handle a product merely for evidence if doing so would create a safety concern.

Submitting a food-safety or allergen claim does not automatically determine the applicable remedy. Eligible resolutions are determined under our Return, Refund & Cancellation Policy, applicable product terms, the facts of the issue, and applicable law.

9. Relationship to Other Policies

This Notice should be read together with our:

• Return, Refund & Cancellation Policy;
• Shipping, Delivery & Pickup Policy;
• Terms of Service;
• Privacy Policy; and
• applicable product-specific food-safety, ingredient, preparation, storage, or handling instructions.

If a specific product has additional food-safety, allergen, preparation, storage, or handling instructions, those instructions supplement this Notice for that product.

Personal information, photographs, videos, order information, communications, and other information submitted in connection with a food-safety, allergen, or order-issue claim are handled in accordance with our Privacy Policy and applicable law.

Nothing in this Notice waives or limits any right, remedy, warranty, disclosure obligation, or consumer protection that cannot legally be waived or limited.
