Introduction

These Gift Card Terms (“Gift Card Terms”) apply to Chefs Collection Food Gift Cards issued or sold by Chefs Collection Food & Supply, doing business as (DBA) Chefs Collection Food (“Chefs Collection,” “we,” “us,” or “our”), including electronic Gift Cards, unless a specific promotion or offer states additional lawful terms.

By purchasing, accepting, or using a Chefs Collection Food Gift Card, you agree to these Gift Card Terms.

1. Nature of the Gift Card

Chefs Collection Food Gift Cards are closed-loop stored-value instruments that may be used toward eligible purchases from Chefs Collection Food through supported Chefs Collection Food sales channels.

Gift Cards are not bank accounts, debit cards, credit cards, or general-purpose payment cards and cannot be used at unaffiliated merchants.

Gift Cards are separate from Shopify Store Credit and from loyalty or rewards points. Different terms apply to those programs.

2. Purchase Price and Loaded Value

The amount paid to purchase a Gift Card and the amount loaded onto that Gift Card may be different when a promotional discount applies.

The redeemable Gift Card balance is the value actually loaded to the Gift Card, as shown in the Gift Card issuance record, Gift Card confirmation, or applicable Shopify record.

A promotional discount on the purchase price does not reduce the loaded value unless the applicable promotion expressly states otherwise.

For example, under our current promotional structure as of the Last Updated date, if a $300 Gift Card is offered for a promotional purchase price of $285 and Shopify issues a $300 Gift Card balance, the redeemable stored value is $300.

Promotional pricing may change prospectively. The promotional purchase price and loaded Gift Card value disclosed for the applicable offer at the time of purchase control.

3. Expiration and Fees

Chefs Collection Food Gift Cards do not expire.

We do not impose activation fees, maintenance fees, dormancy fees, inactivity fees, or other service fees that reduce the Gift Card balance, except only to the extent a different treatment is expressly permitted by applicable law and properly disclosed.

The 3% cancellation/payment-processing fee described in Section 9 is not a fee charged against or deducted from the stored-value balance of a Gift Card. It applies only in the circumstances described in Section 9.

Promotional credits, loyalty rewards, Store Credit, coupons, discount codes, or other benefits that are not Gift Cards may be governed by separate terms.

4. Using a Gift Card

Subject to Shopify functionality and applicable law, Gift Cards may be used for eligible products and applicable order charges through supported Chefs Collection Food checkout methods.

Depending on then-current Shopify functionality:

• a Gift Card balance may be used over multiple eligible orders until the available balance is exhausted;
• multiple Gift Cards may be used toward a single eligible order;
• Gift Cards may be used together with eligible discount codes where supported;
• Gift Card value may be applied toward applicable taxes and delivery or shipping charges where supported;
• if the Gift Card balance is insufficient to pay the full order total, another supported payment method may be required for the remaining balance; and
• a Gift Card cannot be used to purchase another Gift Card.

Gift Cards are not represented as freely reloadable. Any adjustment, restoration, or reload of Gift Card value is limited to circumstances permitted by Shopify functionality, our applicable refund or return procedures, and applicable law.

5. Gift Card Codes and Delivery

Electronic Gift Cards are generally issued with a unique Gift Card code through Shopify.

The purchaser is responsible for providing accurate recipient email or other delivery information when purchasing a Gift Card for another person.

Customers and recipients should protect Gift Card codes from unauthorized disclosure. Access to and visibility of Gift Card codes are subject to Shopify functionality and security practices.

6. Balance

A Gift Card's available balance is reduced as it is redeemed for eligible purchases.

Customers may generally review the available Gift Card balance through the Gift Card page, link, or communication supplied with the Gift Card, subject to Shopify functionality.

7. Cash Redemption

Gift Cards are not generally redeemable for cash except where required by applicable law.

Where California law applies, as of April 1, 2026, a Gift Card with a cash value of less than $15 is generally redeemable in cash for its cash value, subject to applicable statutory requirements and exceptions.

We will honor applicable cash-redemption requirements and other mandatory Gift Card rights under California law and other applicable law.

8. Refunds for Purchases Paid With a Gift Card

If an order paid in whole or in part with a Gift Card qualifies for a refund under our Return, Refund & Cancellation Policy, the applicable refund amount may be returned to the original Gift Card or handled through another legally permitted method depending on the original payment method, transaction, applicable refund, Shopify functionality, and applicable law.

For mixed-payment transactions, allocation of an approved refund among the Gift Card and other payment methods is subject to Shopify functionality, the applicable transaction, our Return, Refund & Cancellation Policy, and applicable law.

Nothing in this section changes the underlying eligibility requirements for a refund.

9. Refund or Cancellation of a Gift Card Purchase

A request to cancel or refund the purchase of a Gift Card itself is different from a refund of merchandise or other products that were paid for using a Gift Card.

If a Gift Card purchase is eligible for a customer-initiated cancellation under our Return, Refund & Cancellation Policy, the applicable cancellation-request window, approval requirements, and refund options apply. Submission of a cancellation request does not automatically cancel the Gift Card purchase.

Electronic issuance or delivery of a Gift Card does not by itself eliminate an otherwise applicable cancellation-request window. However, a Gift Card that has been redeemed or used, in whole or in part, may no longer be eligible for customer-initiated cancellation or refund, except where required by applicable law.

For an eligible customer-initiated cancellation, if the customer chooses a refund to the original payment method, a 3% cancellation/payment-processing fee applies to the applicable original monetary payment amount, as further described in our Return, Refund & Cancellation Policy.

If available and the customer instead chooses to receive 100% of the eligible cancellation amount as Shopify Store Credit, the 3% cancellation/payment-processing fee does not apply.

The 3% cancellation/payment-processing fee does not apply to merchant-caused cancellations.

The 3% cancellation/payment-processing fee is associated with an eligible customer-initiated cancellation and refund to the original monetary payment method. It is not an activation, maintenance, dormancy, inactivity, or service fee charged against or deducted from the Gift Card's stored-value balance.

If an eligible Gift Card purchase is cancelled or refunded, the Gift Card may be deactivated or its balance adjusted as permitted by Shopify functionality and applicable law.

Nothing in this section limits any mandatory Gift Card, refund, or consumer right under applicable law.

10. Lost, Stolen, Misdirected, or Unauthorized Gift Cards

Treat Gift Cards and Gift Card codes like cash and protect them from unauthorized access.

Chefs Collection Food is not responsible for a Gift Card or Gift Card code that is lost, stolen, misdirected, improperly disclosed, intercepted, or used without authorization after proper issuance or delivery, except where required by applicable law or where we determine that replacement or another resolution is appropriate.

If we can reasonably verify the Gift Card, remaining balance, and lawful claimant, we may, where technically feasible, deactivate the affected Gift Card and issue a replacement for the verified remaining balance. Replacement is not guaranteed and remains subject to fraud review, Shopify functionality, and applicable law.

We may require information sufficient to verify the original purchase, purchaser or lawful holder, Gift Card, remaining balance, and circumstances of the loss or unauthorized use.

11. Gift Cards Sent to Another Recipient

Where our Shopify storefront permits a purchaser to send a Gift Card to another recipient, the purchaser is responsible for providing accurate recipient information.

A Gift Card sent to the recipient designated by the purchaser is considered delivered when it is transmitted through the applicable Shopify delivery process to the information provided by the purchaser, subject to applicable law.

If you believe recipient information was entered incorrectly, contact us as soon as possible. We cannot guarantee that a Gift Card can be recalled, cancelled, or replaced after it has been delivered or accessed. This does not eliminate an otherwise applicable cancellation-request right under Section 9 or mandatory applicable law.

12. Loyalty and Rewards Treatment

Purchasing a Gift Card does not earn Chefs Collection Food loyalty points or rewards. No loyalty rewards are earned on the purchase price paid for a Gift Card or on the stored value loaded onto the Gift Card.

Using a Gift Card as a payment method does not, by itself, make an otherwise eligible product ineligible for loyalty rewards. Any rewards earned on the underlying purchase are determined under the then-current Loyalty & Rewards Program Terms, applicable product eligibility, transaction eligibility, discounts, exclusions, and current program functionality.

Products or transactions that are excluded from earning rewards remain excluded regardless of the payment method used. For example, sale items, discounted products, promotional or Combo products, Gift Cards, or other products or transactions designated as ineligible under the Loyalty & Rewards Program Terms or current program settings do not earn loyalty rewards merely because a Gift Card is used as payment.

The use of a Gift Card does not override, remove, or alter any otherwise applicable loyalty-program exclusion.

Loyalty eligibility, earning rates, exclusions, redemption rules, and other program conditions may change prospectively in accordance with the Loyalty & Rewards Program Terms.

13. Fraud, Abuse, and Unauthorized Activity

We may temporarily restrict, deactivate, suspend, cancel, or investigate a Gift Card or related transaction where we reasonably suspect fraud, unauthorized use, theft, unlawful activity, payment fraud, chargeback abuse, manipulation of a promotion, unauthorized duplication or resale of Gift Card codes, or material violation of these Gift Card Terms.

Any action we take under this section is subject to applicable law and does not eliminate a lawful customer's mandatory rights.

14. Gift Cards and Store Credit Are Different

A Chefs Collection Food Gift Card is not the same as Shopify Store Credit.

Gift Cards and Store Credit may differ in issuance, transferability, account association, redemption, cash-redemption rights, technical functionality, and treatment under applicable law.

The fact that Store Credit may be offered as a refund or cancellation option does not convert Store Credit into a Gift Card.

Store Credit is governed by our separate Store Credit Terms.

15. Promotions

Gift Card promotions may establish specific purchase prices, loaded values, eligible denominations, promotional periods, purchase limits, customer eligibility requirements, or other lawful conditions.

Promotion-specific terms disclosed before purchase supplement these Gift Card Terms.

If a promotion-specific term conflicts with a general provision of these Gift Card Terms, the specific promotional term controls for that promotion to the extent permitted by applicable law.

A promotion cannot waive a mandatory Gift Card right that applicable law does not permit to be waived.

16. Changes to These Terms

We may update these Gift Card Terms prospectively as our Gift Card program, Shopify functionality, promotions, sales channels, or applicable law changes.

Material changes will be reflected by updating the Last Updated date and, where required by law, providing additional notice.

Changes do not retroactively reduce the loaded value of an existing Gift Card or eliminate a mandatory right that applicable law does not permit us to eliminate.

17. Relationship to Other Policies

These Gift Card Terms should be read together with our:

• Terms of Service;
• Return, Refund & Cancellation Policy;
• Privacy Policy;
• Loyalty & Rewards Program Terms; and
• Store Credit Terms.

For Gift Card issuance, loaded value, redemption, cash redemption, replacement, and Gift Card-specific restrictions, these Gift Card Terms control, subject to mandatory applicable law.

Refund eligibility for an underlying order remains governed primarily by our Return, Refund & Cancellation Policy.

Loyalty matters remain governed by our Loyalty & Rewards Program Terms, and Store Credit matters remain governed by our Store Credit Terms.

Privacy and personal-information matters remain governed by our Privacy Policy.

18. Mandatory Rights

Nothing in these Gift Card Terms waives, limits, or eliminates any Gift Card, stored-value, refund, consumer-protection, or other right or remedy that cannot legally be waived.

Applicable mandatory law controls over conflicting language.
